課程概述 |
審議民主不僅是當前民主理論一股重要的思潮，也在民主實踐場域逐漸蔚為嶄新的公民參與
模式。本課程的主要目的，在探索審議民主理論與實踐的互動關連。ㄧ方面，我們將探究
「所有具有正當性的法律與政策都應由所有平等的、自由的公民的經由公共說理的方式來產
生」這樣的規範性理念，如何轉化為制度性、程序性的，可以運作的民主實踐，又遇到什麼
阻礙？另一方面，我們要以強調公共討論的公民參與模式的實踐經驗，來檢視審議民主理論
的規範基礎和經驗假定。從理論與實踐的互動關連中，我們將探討：哪些條件，影響了體現
審議民主理念的公民參與實務的發展經驗。

課程目標 |
具體而言，本課程內容包括：
1. 審議民主在當前民主理論中的位置，它的基本理念，與其他民主理念的對照，以及倡導
它的理由，以及對它的批判；
2. 體現「審議民主精神」的公民參與模式的操作原則、實踐經驗與模式比較，尤其著重於
介紹和討論起源於美國的審議式民調、公民陪審團和學習圈，以及起源於歐洲的公民會
議和願景工作坊：
3. 公民如何審議？哪些因素促成公民能夠進行理性知情的討論？審議如何可能產生轉化的
效果？
4. 誰來審議？具有不同社會屬性與位置的公民是否有平等的機會可以參與審議？誰被排
除？參與審議者可以「代表」特定政治社群的公民整體嗎？「代表」的意義為何？誰的
觀點可以再現於審議過程與結果？
5. 在多元差異的社會中，公民審議是否可能，以及如何達成共識？共識是優勢觀點對少數
意見的壓制嗎？差異如何在「共識導向」的討論中被認可？
6. 重視論理的公民審議，是否壓抑情感的表達？公共討論是否可能「情理兼具」？公共說
理與修辭的關連為何？
7.社會運動、利益政治與審議民主的關係為何？強調衝突、策略行動和實力政治的社會運
動，與「溫良恭簡讓」的審議民主是否有內在緊張關係？審議民主如何在傳統的利益政
治過程中運作而影響決策？
8. 公民社會、公共領域與審議民主的關係為何？公民社會與國家的互動關係，以及政治體
系的制度特質和歷史脈絡，如何影響審議民主的發展經驗？

修課要求及成績評量
1. 閱讀指定文獻，積極參與討論。 討論佔學期成績 20％。
2. 每週撰寫一頁的 memo 來討論閱讀文獻。Memo 佔學期成績 40％。
3. 針對本課程索討論的特定主題，撰寫一萬字的期末報告。題目須先經過我同意。 期
